The Components of a Complete Advance Directive

Living Will

Florida’s Legal Requirements for a Valid Living Will

Advance directives in Florida, including living wills and health care surrogate designations, are governed by Florida Statutes Chapter 765. A durable power of attorney authorizing an agent to make health care decisions falls under Florida Statutes Chapter 709. A document that doesn’t meet the statutory requirements might not be honored, no matter how clearly it expresses your wishes.

A Florida living will must be signed by you in the presence of two witnesses, and at least one of those witnesses can’t be your spouse or a blood relative. When an Advance Directive Takes Effect
